Or, le travail est un élément essentiel à la consécration de la dignité et de la cohésion sociale. Il faut donc comprendre les raisons de l’inefficacité des politiques publiques et trouver des leviers juridiques. Jusqu’à présent, ancrée dans une dynamique de justice sociale dépendante de l’intervention de l’État, l’inclusion professionnelle n’a porté qu’une attention limitée à l’entreprise la contraignant ou l’incitant financièrement. Le sujet doit être présenté différemment. La personne en situation de handicap, engagée dans un parcours professionnel, ne doit pas avoir un statut spécifique stigmatisant. Elle est avant tout un travailleur dont l’entreprise a besoin pour développer son activité. Il faut dépasser le climat de méfiance envers l’entreprise qui a émergé avec les organisations du travail du début du XXème siècle peu soucieuses du bien-être des salariés. L’entreprise a évolué et joue un rôle social avec la mise en œuvre de la responsabilité sociale des entreprises. Mais l’entreprise ne peut y arriver seule. Pour parvenir à une inclusion professionnelle effective, elle a besoin du soutien du secteur sanitaire et médico-social qui doit être accompagné dans cette évolution. With an employment rate of only 44% of people recognised as disabled compared to 73% for the rest of the population in 2021, France can hardly dispute the ineffectiveness of its legal framework in relation to the professional inclusion of people with disabilities. Yet work is an essential element in the consecration of dignity and social cohesion. It is therefore necessary to understand the reasons for the inefficiency of public policies and to find legal levers. Until now, anchored in a social justice dynamic dependent on state intervention, professional inclusion has only paid limited attention to the enterprise, either by constraining it or by providing financial incentives. The subject needs to be presented differently. Person with disabilities, engaged in a professional career, should not have a specific stigmatising status. He or she is above all a worker that the company needs to develop its activity. We must overcome the climate of mistrust towards the company that emerged with the work organisations of the early 20th century, which were not very concerned with the well-being of employees. The company has evolved and plays a social role with the implementation of corporate social responsibility. But the company cannot do it alone. To achieve effective occupational inclusion, it needs the support of the health and medical-social sector, which must be accompanied in this evolution.
