Cour de cassation Droit -- Méthodologie e contrôle de conventionnalité, contrôle sui generis, est à l’origine d’une mutation inédite de l’office judiciaire. Exercé de manière empirique depuis sa consécration en 1975 par la Cour de cassation, il s’est développé de manière relativement inattendue en matière civile et ce, principalement sous l’influence de la Convention européenne des droits de l’Homme. L’avènement du contrôle de conventionnalité in concreto en 2013 a marqué un net tournant dans les méthodes judiciaires en même temps qu’il a révélé le phénomène contemporain de transformation de l’office du juge. Cette évolution conduit désormais les juges judiciaires à tenter de dépasser l’empirisme méthodologique en vue d’institutionnaliser ce contrôle. Dans cette perspective, un état des lieux de la pratique, des ambiguïtés quant à ses modalités d’application aux zones d’ombre de la sanction de l’inconventionnalité, permet d’en affiner la méthodologie et amène à repenser son exercice. Cette réorganisation, pour atteindre une efficience pratique, doit être pensée dans une logique dialogique d’ensemble, incluant tous les acteurs du contrôle, institutionnels comme juridictionnels. Ainsi, nouant de véritables relations tant avec le législateur, le Conseil constitutionnel, qu’avec les juges de la conventionnalité – juges du fond et juges administratifs -, les vertus de ce dialogue renouvelé dans le cadre de l’exercice du contrôle de conventionnalité pourraient offrir aux juges judiciaires la possibilité de faire évoluer leurs missions sans dénaturer leur office. Conventionality control, a sui generis form of review, has been the source of an unprecedented change in the office of judge. Exercised in an empirical way since its sanctioning by the Court of Cassation in 1975, it has developed in a relatively unexpected way in civil matters, mainly under the influence of the European Convention on Human Rights. The advent of in concreto conventionality control in 2013 marked a clear turning point in judicial methods, while at the same time revealing the contemporary phenomenon of the transformation of the office of judge. This evolution is now leading judges to try to go beyond methodological empiricism in order to institutionalize this form of review. In this perspective, an inventory of the practice, from the ambiguities regarding its application to the grey areas pertaining to the sanction of unconventionality, allows for a refinement of its methodology and leads to a rethinking of its exercise. This reorganization, in order to achieve practical efficiency, must be thought out in a global dialogical logic, including all the participants in the control process, institutional as well as jurisdictional. Thus, by establishing real relations with the legislature, the Constitutional Council and the conventionality judges - trial judges and administrative judges - the virtues of this renewed dialogue in the context of the exercise of conventionality control could offer judicial judges the possibility of developing their missions without unduly changing the nature of their office.
