Pourtant, le dommage possède une dimension temporelle certaine qui, rarement réduite à un instantané par la norme juridique, traduit son existence et influe sur sa consistance. La durée du dommage, qui s’entend de l’étendue temporelle identifiée par deux instants fondateurs et reconnue par la norme juridique de l’atteinte subie par la victime, appartient au temps juridique. A ce titre, elle est marquée par une distanciation entre ses règles de mesure et celles de la durée existante dans le temps mathématique de l’Horloge. Cette lecture de la durée par le droit se répercute sur la caractérisation même du dommage. En tant que composant de l’atteinte, la durée du dommage permet alors d’en identifier le comportement temporel. Participant à la détermination de la consistance de l’atteinte, la durée du dommage constitue également un élément d’évaluation du montant de l’indemnité accordée à la victime. Cependant, la réparation accordée au titre de l’élément temporel de l’atteinte est trop souvent implicite et parfois partielle. Par ailleurs, l’incertitude entourant la caractérisation de l’étendue temporelle de certaines atteintes, ajoutée à l’imprécision des règles d’évaluation, met en exergue les difficultés pour la victime d’obtenir une pleine réparation de son dommage. La durée du dommage revêt ainsi plusieurs intérêts que ce soit pour la définition du dommage que pour sa réparation. Toutefois, les difficultés présentées par la notion invitent à s’intéresser à l’identification de ses caractéristiques et à son régime de réparation. Although being a fundamental notion of civil liability law, damage is still relatively unknown and studies on the subject are limited to examining its materiality to the detriment of its temporality. However, the damage has a certain temporal dimension which, rarely reduced to a snapshot by the legal norm, reflects its existence and influences its consistency. The duration of the damage, which is understood to mean the temporal extent identified by two founding moments and recognized by the legal standard of the damage suffered by the victim, belongs to legal time. As such, it is marked by a distance between its measurement rules and those of the duration existing in the mathematical time of the Clock. This legal interpretation of duration has repercussions on the very characterization of the damage. As a component of the damage, the duration of the damage then makes it possible to identify its temporal behavior. Participating in determining the consistency of the damage, the duration of the damage is also an element in assessing the amount of compensation awarded to the victim. However, the remedy awarded under the temporal element of the infringement is too often implicit and sometimes partial. Moreover, the uncertainty surrounding the characterization of the temporal extent of certain damages, added to the imprecision of the assessment rules, highlights the difficulties for the victim to obtain full compensation for his damage. The duration of the damage thus assumes several interests both for the definition of the damage and for its compensation. However, the difficulties presented by the concept invite us to look at the identification of its characteristics and its remedy.
